Terms and Conditions for Web Design Services

These Terms and Conditions form the agreement between you (the “Client”) and [Your Web Design Company Name] (the “Company”). By engaging our services, you agree to these terms.

1. Scope of Work

  • The Company will provide web design and development services as outlined in the agreed proposal or contract.
  • Any additional work outside the agreed scope will be charged separately.

2. Client Responsibilities

  • Timely Content Submission: The Client must provide all required materials (e.g., text, images, logos) in a timely manner. Delays in submission may impact project timelines.
  • Approval and Feedback: The Client is responsible for reviewing work and providing timely feedback to ensure the project stays on schedule.
  • Ownership of Content: The Client guarantees they own or have permission to use all text, images, and other assets provided. The Client indemnifies the Company against any claims arising from their use.

3. Project Timelines

  • The Company will make every effort to meet agreed deadlines. However, delivery dates may extend by 4-5 business days in case of unforeseen circumstances.
  • Delays caused by the Client, such as late content submission or approvals, will result in corresponding timeline adjustments.

4. Revisions

  • The project includes up to 2 major revisions. Additional revisions beyond this will incur extra charges as per the Company’s standard rates.
  • Revisions must stay within the original project scope.

5. Payments

  • Deposit: A 50% deposit is required to begin work.
  • Payment Schedule: Payments must follow the agreed schedule. Full payment is required before the website goes live.

Refunds:

  • If the Client cancels the project after design approval but before launch, the Company may retain up to 85% of the project cost based on work completed.
  • No refunds will be issued once the website goes live.

6. Ownership and Copyright

  • Upon final payment, the Client owns all visual elements, text, and graphics provided by them.
  • The Company reserves the right to display the completed website in its portfolio unless the Client requests otherwise before the website launch.

7. Hosting and Support

  • The Company offers hosting with 99.95% uptime. Hosting services are subject to a separate agreement.
  • If hosting with a third-party provider, the Company cannot guarantee compatibility or technical support.
  • Support and maintenance packages are available upon request.

8. Liability

  • The Company is not liable for missed deadlines due to Client delays.
  • The Company is not responsible for losses arising from errors, downtime, or security issues unless part of an agreed maintenance plan.

9. Cancellation

  • A minimum of 30 days’ notice is required to cancel hosting, support, or maintenance contracts.
  • Early termination of annual contracts will require full payment of the remaining balance.

10. Confidentiality

  • Both parties agree to keep confidential any proprietary or sensitive information shared during the project.

11. Force Majeure

The Company will not be held liable for delays or failure to deliver services due to events beyond its control, including natural disasters, technical failures, or government actions.

12. Changes to Terms

The Company reserves the right to modify these terms at any time. Updated terms will be available on the Company’s website.
